These Terms of Service govern your access to and use of bricksmart.store and any products, memberships, information, or services offered by BrickSmart LLC (“BrickSmart,” “we,” “us,” or “our”).

By visiting our website, placing an order, or enrolling in the VIP Club, you agree to these Terms.

1. Our Services

BrickSmart is an online information-access business. We provide customers with digital access to curated vendor information and related resources that may help customers locate third-party sellers offering products at wholesale or discounted prices.

BrickSmart offers:

• Individual vendor-information purchases delivered electronically.
• VIP Club membership providing access to multiple vendor resources.
• Other digital downloads, links, guides, or informational resources displayed on our website.

BrickSmart supplies digital information only. Unless a product page expressly states otherwise, no physical product is included in a purchase made from BrickSmart.

2. Third-Party Vendors

BrickSmart does not manufacture, warehouse, sell, pack, or ship the physical products offered by vendors identified through our service.

Any purchase made from a third-party vendor is a separate transaction between you and that vendor. BrickSmart is not responsible for a vendor’s:

• Product quality or authenticity.
• Pricing or availability.
• Shipping or delivery.
• Customer service.
• Refund, return, exchange, or warranty policies.
• Compliance with applicable laws.

Vendor information may change without notice. We do not guarantee that any vendor, product, price, promotion, or inventory will remain available.

3. Orders and Payments

You agree to provide current, complete, and accurate billing and contact information.

We may refuse, cancel, limit, or review an order where we reasonably suspect fraud, unauthorized activity, abuse, pricing errors, or violations of these Terms.

Prices are displayed in U.S. dollars unless otherwise stated. Applicable taxes or fees may be added where legally required.

4. Digital Delivery

Individual vendor information is delivered automatically to the email address entered during checkout.

VIP Club access is activated automatically following successful payment and may be provided through email, a secure link, an account, or an online membership portal.

You are responsible for providing a valid email address and checking spam, junk, promotions, and filtered folders.

5. VIP Club Membership

VIP Club memberships automatically renew at the price and frequency disclosed during checkout. Previous drafts used $39.99 every 30 days unless otherwise stated at checkout.

By enrolling, you authorize BrickSmart or its payment processor to charge your selected payment method automatically until cancellation.

You may cancel future renewals by contacting BrickSmart before your next billing date. Cancellation stops future charges but does not normally produce a refund for the current billing period. Access may continue through the end of the paid membership period.

6. Refunds

Because vendor information is delivered electronically and cannot be returned after disclosure, completed digital purchases are final and non-refundable after delivery.

BrickSmart may correct:

• Duplicate charges.
• Verified billing errors.
• Failed delivery that BrickSmart cannot correct.
• Membership-access problems that BrickSmart cannot restore.

Nothing in these Terms limits any non-waivable rights available under applicable law.

7. Limited License

Your purchase provides a limited, personal, non-exclusive, non-transferable license to use the information for your own lawful purposes.

You may not:

• Resell, redistribute, publish, or share vendor information.
• Upload it to another website, group, marketplace, or database.
• Copy or commercially exploit BrickSmart’s vendor lists.
• Share VIP Club credentials with another person.
• Attempt to bypass access or payment controls.

Unauthorized distribution may result in termination of access without refund.

8. Intellectual Property

BrickSmart’s website, branding, written materials, vendor compilations, graphics, downloads, and original content are owned by BrickSmart LLC or used with permission.

Third-party names and trademarks belong to their respective owners. Their appearance does not imply sponsorship, endorsement, or affiliation.

9. Disclaimer of Warranties

BrickSmart’s services and information are provided “as is” and “as available.”

We do not guarantee that:

• A vendor will continue operating.
• A vendor will accept your order.
• A particular product or price will be available.
• Vendor information will always remain unchanged.
• Products purchased separately will meet your expectations.
• Access will always be uninterrupted or error-free.

10. Limitation of Liability

To the maximum extent permitted by law, BrickSmart LLC will not be liable for indirect, incidental, special, punitive, or consequential damages arising from your use of the website, vendor information, VIP Club, or any third-party vendor.

BrickSmart’s total liability arising from a particular purchase will not exceed the amount paid directly to BrickSmart for that purchase.

11. Fraud and Abuse

We may suspend or terminate an order, account, or membership when we reasonably believe a customer has:

• Used fraudulent payment information.
• Shared or resold vendor information.
• Abused refund or dispute procedures.
• Attempted unauthorized access.
• Violated these Terms.

12. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.

13. Changes

We may update these Terms periodically. Updated Terms become effective when posted on our website with a revised date.
